Can you get arrested for bein drunk on your on property? This is the story. So last night we had a little thing at our house an my brother (26) was drunk an he was in the driveway. The cops came an threatened to arrest him for bein drunk in public. Is this legal? Doesn't seem like it to me

 

Drunk in public is exactly what it is.

 

lol shouldn't have been done, it was in his home. SUE THERE B_TCH ass... it's not in public, it's private... i think you got a case.... unless the driveway is part of the city, then your fu_ked!

 

On the driveway is considered pubic because you can be seen by others. They( the cops) might have suggested that you take it back inside.

 

that's bull sh_t... i'd still take this to court...

 

^^^First of all he didn't sited or arrested so there isn't going to be a court date. Second don't waste your money fight the government, spend it on your truck

Anyways. So what if he threatened him.. did he do it ? No. be happy hes not in jail, chances are if they were threatening him, they had a reason. cops can say they want.... When your dealing with a drunk and you need him to cooperate you may need to tell him hes going to jail to get it through his head.

 

Same thing like if you was walking around your property naked. Cops would still come and tell you something, especially if others can see it like how garagedoorman said.
